    Friends,
    In your opinion, if we were to choose among the many amendments people are proposing to improve the pending immigration billsm what will you choose?

    My choice is
    1. Either remove country quota
    or
    2. Re-instate soft quota.

    Other choices could include
    1. Filing of 485 with pri dates
    2. H1b extension by 3 yrs with pending labor
    3. Including MBA under stem

    One request - please think of the broader implications of your choice and not your case. E.g, my wife has 140 pending approval and 485 will help me immensely but I would rather have the GC than EAD, so that is why I chose country quota removal. It unfairly victimizes an individual for his/he country of birth.

    When you say I can retain the priority date, how does that work? Do I have to file the PERM again? Isn't the PERM what gives us the priority date? And then will I have to file the I-140 or is it that I need to file the I-140 only?

    OK if I go the convert to Eb2 route..when do Ihave to shift to the new employer..after the new PERM is approved or after the I-14o is approved??.

    Reminder: Those living in highrise apartments or large apartment complex should put up the names of their family members on the mail box such that the green card mails are not returned to the USCIS. Under the current USCIS policy, the U.S. Postal Services are not permitted to deliver the USCIS enevelope with "Return Requested" red stamp other than the specific individual named on the envelope. This is particularly true with the green card delivery.

    Hi everybody,
    Can someone show me how to adjust status of b1 visa to permanent resident in the USA. I have a friend. She has a US citizen brother who had sponsered her to the USA. However she just received the receipt notice (pending case) from USCIS. Now she is staying in the USA with the b1 visa. How can she adjust her status to get the green card?

    My wife went for her biometrics today and what a surprise, her date of birth on the system was wrong.
    She only had DL on her and no passport. So, the ASC staff took her biometrics but refused to correct her DOB, claiming that passport was needed.
    So, we called up USCIS and upon description of the problem,were immediately transferred to level 2. Level 2 looked at the cases and confirmed that DOB was wrong on I-485. It was correct in I-765 and I-131. She said that the only way to correct it was to take infopass and present passport and DL.

    It is now more or less clear that DOB mismatch has caused her EAD to be stalled for so long.I have already got my EAD.

    Moral of the story : take passport for FP, infopass, etc. all the time.

    Our EADs and APs were filed separately with I-485 courier receipt. What a mess !!

    lets see what happens at infopass.

    Yes, USCIS is a Jungle and not sweet

    Thanks for the tip, I'm going to experiment. It's good to have a bunch of different tools and techniques, not all images behave the same in Photoshop.

    I am beginning to really like the 100-400, as was a bit worried as the first few images were not good at all, but as I learn how to use it I see it's all my fault. :)

    Hi! I am on a H1 - B visa and had a question. If I marry someone from my home country India and she is working out there as a physiotherapist, can she come here and start practicing immediately or she needs to give some exams and do I need to file her H1 - B in the quota opening in April or is she outside the quota?

    Dear Friends:
    I also have a similar question on traveling abroad for 4 weeks with my 485 pending.
    As you all know that when we applied our 485 AOS (EB-based) we had to also submit the copy of our latest 1-94 card (which I did). Now that I am leaving the US, I will be handing over the original 1-94 at the port of exit (a copy of which was submitted with the 485 application). Then when returing, I will be receiving another new 1-94. So my questions:

    (a) Will I have to re-send the INS another copy of my new 1-94 when I return to the US (b) also might surrendering the old 1-94 and getting new one confuse my 485 records with the INS (c) Finally, do any of you know of anyone who with 485 pending, a valid H1B visa, and no Advanced Parole has had any problems returning back to the US?

    Please advise, and that would be so appreciated. Regards.

    RFE and NOID come with a color sheet of paper with your details and some USCIS internal codes for your case. You can respond by yourself and put the sheet on top - this is for the mailroom to handle your case

    If we do not use G28 to change representation from current lawyer hired by company, would all the notifications go just to the lawyer?

    Can we submit G28 ourselves or does it needs to be a lawyer?

    when you got H1 did you receive new I-94? If yes, then you should have been working with the employer who did your H1 and not L1 employer. If not you should be able to COS to H1 without issues.

    I have applied H1 through consulate process so I did not get I-94 . I have H1 approval receipt.
    During COS process ..I will not be working on project so is this become problem for denial of COS status

    Please advice...
