    I think your attorney is right... Was your 140 approved in September.. meaning.. is Sept 19 close to your approval date? if that is the case I wouldn't worry. But if your approval was much earlier than Sept then it could be something to clarify from USCIS.

    our paroles were updated on the website as being mailed on sept26, we still haven't received them but we did receive ead cards which were approved on sept 28. No sign or notice of AP or FP yet

A report in The Cherry Hill Courier Post quotes a spokesman for the Senate Majority Leader "[Mr. Reid] plans to take up immigration reform but is still working with the new administration on timing ... House leaders also have promised to consider measures." As to when comprehensive immigration reform will come up before Congress, Immigration Daily has learnt that it will come to the floor early in 2009 though it is not currently planned for Mr. Obama's first 100 days. The Cherry Hill Courier Post quotes Sen. Menendez "If lawmakers don't consider the issue early, it could 'slide into midterms' -- the 2010 election -- and again become a contentious campaign issue. This is one of those issues that needs to be done early on."

    Sen. Menendez and Rep. Gutierrez are on the warpath for early passage of CIR in the 111th Congress. Sen. Menendez had the courage to singlehandedly block a five year extension of E-Verify, and will doubtless push for a significant immigration benefits downpayment before March 6th when E-Verify is set to expire. Rep. Gutierrez and the House Hispanic caucus successfully blocked immigration benefits legislation in the 110th Congress to ensure continued support for CIR.     Hello All,

    The lawyer did send separate checks and the applications were sent in a single package. As stated earlier I got my receipts. But my wife's check is not cashed yet. But today's (Aug 17th, 2007) receipting update from USCIS http://www.uscis.gov/files/pressrelease/ReceiptingTimes081707.pdf states that they have completed for July 2nd filers. Mine was submitted on July 2nd 2007. What are my options now?

    1. What could be done if my wife's application was lost by USCIS?

    2. What are the chances that I can re-file my wife's application again?

    Please answer.

    Considering,
    - EB3-EB2 upgrade
    - Slow VB date movement
    - No FB spillover
    - Growing economy (which will further reduce the spillover/across numbers further in coming years)

    Have you ever wondered what are the options you have?

    We know, we are stuck with H1. Some of our problems are
    - Resumes are rejected as many(most) companies prefer Citizens/GC/EAD than H1.
    - Many RFEs and question with H1 Extn.
    - Getting visa stamp at consulates is a (mental) pain.
    - Consider the time spent from vacation for getting visastamps.
    - Problems at port of entry( So many questions). We don't know what is new in store when we comeback from vacation.
    - Pain of planning for a short visit(week) for emergency issues/family functions.
    - Hard time in finding a H1 sponsor for H4 dependants

    We know for sure that we are not going to get GC now. We don't know the exact wait time. What is our interim relief? Have you ever wondered how an EAD and AP will help you in the current situation? Have you ever dreamt the return of summer of 2007?

    "Word-of-Mouth" seems to be the most effective way of campaigning! I had sent mails, and left voice to couple of my friends some time back. They became aware of IV, but not yet registered. Talked to them today, and got both of them registered. (kasas & aksrao).

    Requested them to spread the word, "IV". I am sure they will read this thread and campaign for "IV".

    I applied for my second AP on 08/11/2009, was approved on 09/03/2009, was received at the attorney's office on 09/10/2009. Service center NSC.

    No FP was done. FWIW my last FP was in Jan 09.

    Did you guys have to go through FP for the APs? Will they take FP again even if they have done that before.

    I was wondering if anyone here who had a canadian PR (i.e. did a landing), got GC later has travelled again to Canada again?
    We got canadian PR in 2005 and did a landing while we were waiting for our GC. We got a our GC last year and are planning to visit canada using our GC. Are there going to be any issue in entering canada?

    Also, we travelled to India last year and received new I-94 when we got back into US using AP. Very soon (days) we received our GC's. I am not sure what do with these I-94's when we leave US. Do we still need to surrender these as in the past?

    For some grilling by both CBP in the US and also their Canadian counterpart. You should've surrendered the Canadian PR or US GC based on where you wanted to live permanently. It's not illegal to be a PR of both countries, but if the Canadians know and if you've claimed any sort of health insurance in Canada, they'll send you a bill for it. All this is not to scare you, but first hand experience of my cousin who lives on the border and works for a Detroit based company.

    Time and again I hear people here and everywhere complaining about how "everyone-who-is-a-citizen" is simply out to get them and exploit them.
    HR is bad mouthed. Lawyer is called a single $ whore. the list goes on.

    By no means you are wrong.... what y'all say is correct to every extent of the word... but do you believe its because they are doing it so. Take a moment, think and tell me if you honestly believe that.
    When was the last time garbage smelled nice... i don't see any of us complaining about that. Seriously, who else is not out to get you. let me answer that... EVERY-- FU**IN---BODY

    Point is, when some law-maker, anti-immigrant, citizen john doe, his wife mary hoe come to the site, she should see the reflection of our high education and quality of thinking in the forums here. They have to feel our maturiy, charisma and elevated thinking in the posts we leave here.

    Think of yourself as the really smart good lookin guy and "all these poeple" as the duette you wanna go out with. For once, we have to stop being cry winches.. and let people know who we really are.....

    Was the extension with current employer applied before the expiry of your current I 94? Then only 240 days rule apply. Otherwise your are accumulating illegal presence.

    You need help from a good competent attorney instead of advise from forum; your case is quite complicated. If not handled properly, you may be subject to 3/10 bar. In any case, you need a very good legal advise even before you leave US.

    I wish I should I have acted against the USCIS notice on july 2nd saying they will reject. I should have listened to Rajiv khanna website who was saying that the app should be filed even if it was sent back.
    But my attorney said its no use to beat the system and I should wait till october.
    I listened and kept quite for few days and later decided on July 16th that What the heck !!!. Let us submit even if it is returned and went ahead.

    Every day matters as the counter is 180 days. It is like a time bomb clock.

    I think now we can just mark on our calendars the 180 days which includes some months of 31 days and mark exactly the date and time and plan to celeberate it to fulliest.

    When you mark your calendar, mark it for 182 days to be safe. You never know USCIS and these employers.. Keep yourself safe from all the complications that might arise if you leave on 180th or 181st day (whether first day is included or not, can I leave on 180th day or do i have to wait for 180 days to complete blah blah.. ) :)

    I Agree it is better not to take risk. But why is this an issue after 3 years of working from home. Next question is If I ask my lawyer not to renew my H1B and only work on EAD does DOL have an issue ? is that risk worth taking. Moving my family entirely for this reason is not a good option.

    you can travel until the Expiry date stamped on your Visa in your passport allows you to reenter.

    For example, if your visa expires on 15th March 2007, you better be here on 14th :-)) and when you leave after that, you will need to have the visa revalidated at a consulate/embassy, which, I think you are aware of based on your post.
